YACHT RENTAL TERMS AND CONDITIONS

Please read these Terms & Conditions carefully before booking any services. By confirming a reservation with Boat and Bay, you (the "Client") agree to be bound by the terms below. These terms govern all charter services provided by Boat and Bay and are designed to ensure a clear, transparent, and enjoyable experience for everyone on board.

1. Definitions

For the purposes of these Terms & Conditions:

  • "Boat and Bay" refers to the charter company operating under that name in Puerto Vallarta, Mexico.

  • "Client" refers to the individual who makes the reservation and is responsible for the group.

  • "Guest(s)" refers to all individuals on board during a charter, including the Client.

  • "Charter" refers to the private yacht rental service booked by the Client.

  • "Captain" refers to the licensed maritime professional assigned to the vessel.

2. Booking & Payment

2.1 Reservation Confirmation

A reservation is confirmed only upon receipt of a deposit. The deposit is 50% of the total charter price, which includes the base charter rate and any selected add-ons (catering, beverages, transportation, onboard services, or other enhancements).

2.2 Balance Due

For wire transfers, credit card payments, or other electronic payment methods: the remaining 50% balance must be received no later than 72 hours before the charter date.

For cash payments: the remaining balance is due in full prior to boarding on the day of the charter.

Failure to meet the applicable payment deadline may result in automatic cancellation of the reservation. In such cases, the deposit already paid will be forfeited.

2.3 Accepted Payment Methods

Bank wire transfers, online/credit card payments, and cash (payable in full before boarding).

 

2.4 Chargebacks

Chargebacks initiated without prior communication and without valid justification constitute a breach of contract. Clients are strongly encouraged to contact Boat and Bay directly to resolve any concerns before initiating a chargeback.

In the event of an unjustified chargeback, Boat and Bay reserves the right to pursue legal action and to charge an administrative fee of USD $150 to cover processing and documentation costs. The Client will be responsible for all associated legal, banking, and processing fees.

3. Cancellation & Rescheduling Policy

3.1 Standard Cancellation Terms

  • 15> days before charter: Full deposit refund, minus USD $45 admin fee

  • 8–14 days before charter: 50% of deposit refunded, minus USD $45 admin fee

  • 7 days or less before charter: No refund. Rescheduling within 12 months available, USD $45 admin fee applies

  • After final payment (within 72 hrs): Full amount forfeited. Rescheduling at Boat and Bay's discretion.

3.2 Rescheduling & Processing Fees

Rescheduling fees are determined at the time of the request based on operational costs. A USD $45 administration fee applies to all rescheduling. Payment processing fees charged by credit card networks or online platforms are non-refundable under all circumstances.

 

3.3 Holiday Dates

For charters on January 1, December 24, December 25, or December 31, the deposit is strictly non-refundable regardless of the cancellation date.

3.4 Refund Processing

Approved refunds will be processed within 21 business days of written cancellation confirmation.

 

3.5 How Cancellation Days Are Counted

The charter date itself is not counted. The countdown begins the day before the charter date.

Example: Charter on October 15.

• Full refund minus $45: September 30

• 50% of deposit refunded: October 1 – October 7

• No refund: October 8 onward (7 days or less)

We strongly recommend purchasing travel insurance to protect against unforeseen personal circumstances such as flight cancellations, illness, or family emergencies.

4. Arrival, Late Arrival & No-Show

4.1 Punctuality

Clients and guests must arrive at the designated embarkation point at the agreed departure time. A grace period of 5 minutes is allowed.

Arrival after the grace period will not result in an extension of the charter. The Client remains responsible for the full booking amount.

Early returns do not entitle the Client to any refund.

4.2 No-Show

A Client is considered a no-show if they fail to arrive at the embarkation point within 30 minutes of the agreed departure time without prior notification.

In the event of a no-show, the entire booking amount is forfeited and no refund will be provided.

5. Captain, Crew & Fuel

All charter rates include a licensed captain, required crew, and fuel for the itinerary as agreed at the time of booking. The captain has full authority over all operational and safety decisions on board.

6. Weather, Port Conditions & Force Majeure

All charters operate in accordance with applicable Mexican maritime law and the professional judgment of the licensed captain. The operational status of a charter is assessed based on official port status at the scheduled departure time.

 

6.1 Official Port Closure or Government Restriction

If the charter cannot legally operate due to an official port closure or formal restriction issued by the Harbor Master (Capitanía de Puerto) or another competent mexican governmental authority at the scheduled departure time, the Client may choose to:

(a) reschedule to a future available date at no additional cost; or

(b) receive a full refund of payments made, excluding non-refundable third-party processing fees.

 

Temporary closures occurring prior to the scheduled departure time that are lifted before departure do not automatically trigger cancellation.

 

6.2 Unsafe Weather Conditions

If the captain determines that weather or sea conditions are unsafe for navigation — including severe storms, dangerous sea state, or winds exceeding safe operational limits — the charter will not proceed. In such cases, the Client may choose to reschedule at no additional cost or receive a full refund (excluding non-refundable processing fees).

All safety determinations are made solely by the licensed captain in accordance with Mexican maritime regulations.

 

6.3 Unfavorable but Safe Weather

Charters operate in outdoor maritime environments. Light rain, overcast skies, moderate wind, or other conditions that do not prevent safe navigation do not constitute grounds for cancellation.

If the captain and maritime authorities determine that conditions are safe to operate, the charter will proceed as scheduled.

Should a Client choose to cancel or reschedule due to personal weather preference when conditions are safe, the standard cancellation policy in Section 3 applies.

 

6.4 Weather Forecast Disclaimer

Weather forecasts are estimates provided by third-party services and may change at any time. Boat and Bay does not guarantee sunshine, calm seas, water visibility, or wind levels. Differences between forecasted and actual weather conditions are not grounds for cancellation or refund unless the captain determines that conditions are unsafe to operate.

 

6.5 Force Majeure

Boat and Bay shall not be liable for failure or delay in performing charter services when such failure results from an extraordinary event beyond the reasonable control of both parties (a "Force Majeure Event").

To qualify, the event must:

(a) make the charter legally impossible, officially restricted, or unsafe to operate;

(b) be actively occurring at the scheduled departure time or within 24 hours immediately prior to departure; and

(c) directly affect Puerto Vallarta or the Banderas Bay maritime zone.

 

Force Majeure Events include, but are not limited to:

  • Natural disasters: hurricanes, tropical storms, earthquakes, tsunamis, flooding, landslides, volcanic eruptions, or wildfires

  • Severe maritime conditions resulting in official operational restrictions

  • War, armed conflict, terrorism, or credible security threats affecting the departure location

  • Widespread civil unrest or states of emergency

  • Official port closures, navigation bans, or maritime restrictions

  • Mexican Government-ordered evacuations

  • Legally binding travel prohibitions or border closures

  • Epidemics or pandemics resulting in legally binding government restrictions

  • Major infrastructure failures including marina closures or fuel supply disruptions

 

Force Majeure determinations are based exclusively on formal actions by competent authorities: Mexican federal, state, or municipal authorities; the Harbor Master (Capitanía de Puerto); or Mexican maritime or civil protection authorities. Advisories or warnings from foreign governments (e.g., the U.S. State Department or Government of Canada) do not constitute Force Majeure unless they impose legally binding travel bans or border closures making travel to Mexico legally impossible. Media reports, social media, airline notices, or cruise line advisories do not qualify.

If a qualifying Force Majeure Event prevents the charter from operating, the Client may choose one of the following:

  • Option A – Reschedule: to a future available date without penalty.

  • Option B – Charter Credit: equal to the charter value, valid for 12 months and transferable to friends or family.

  • Option C – Refund: of payments made, excluding non-refundable processing fees, the USD $45 administration fee, and any operational expenses already incurred. Refunds will be processed within 21 business days of written cancellation confirmation.

 

6.6 Personal Circumstances — Not Considered Force Majeure

The following personal circumstances do not qualify for cancellation, rescheduling, or refund outside the standard cancellation policy:

  • Personal illness or medical conditions

  • Family emergencies

  • Travel anxiety or personal fear of travel

  • Passport or visa issues

  • Missed, delayed, or cancelled flights

  • Cruise ship delays or schedule changes

  • Late arrival at the departure location for any reason

  • Changes in personal travel plans

  • Travel advisories that do not legally prohibit travel

Clients are strongly encouraged to obtain comprehensive travel insurance to cover personal travel disruptions, including flight delays, illness, and other unforeseen personal circumstances.

7. Changes Made by Boat and Bay

7.1. Boat and Bay reserves the right to modify bookings in the event of unforeseen circumstances such as mechanical failures, vessel unavailability, or safety concerns. Clients will be notified as promptly as possible.

7.2. Where changes are necessary, Boat and Bay will offer alternatives including rescheduling, a comparable replacement vessel, or a full refund. If the Client is unable or unwilling to accept the proposed alternatives, a full refund will be provided. No additional compensation beyond a refund or rescheduling will be offered for changes resulting from unforeseen events.

7.3. Boat and Bay reserves the right to substitute a comparable vessel if the originally reserved yacht becomes unavailable due to mechanical issues or operational circumstances.

7.4. Boat and Bay cannot guarantee the presence, proximity, or visibility of wildlife including dolphins, whales, turtles, or other marine life, as these occur unpredictably in their natural environment.

8. Safety Regulations

8.1. By participating in the charter, all Clients and Guests acknowledge that maritime activities involve inherent risks including swimming, boarding vessels, and exposure to ocean conditions. Guests voluntarily assume these risks.

 

8.2. All Clients and Guests must adhere to safety instructions provided by the captain and crew at all times. The captain has full authority to enforce safety measures to ensure the well-being of all persons on board.

 

8.3. Excessive alcohol consumption, unsafe behavior, or failure to follow crew instructions will not be tolerated and may result in immediate termination of the charter without refund.

 

8.4. Engaging in illegal activities, including the consumption of illegal substances, is strictly prohibited and will result in immediate termination of the charter without refund.

8.5. Boarding and disembarking the vessel is permitted only when authorized by the captain or crew.

 

8.6. Guests swim in the ocean at their own risk. The use of a life jacket is strongly encouraged at all times when swimming or participating in water activities.

 

8.7. Clients are encouraged to obtain travel insurance to cover potential risks and liabilities.

 

8.8. Environmental guidelines including proper waste disposal must be observed by all Guests to minimize ecological impact.

 

8.9. The Client who makes the reservation is responsible for the conduct and compliance of all Guests in their group. Any damage, misconduct, or violation of these Terms caused by any Guest is the responsibility of the booking Client.

9. Children & Parental Responsibility

Parents or legal guardians are fully responsible for supervising their children on board at all times. Any damage caused by children is the financial responsibility of the parent or guardian.

Life jackets are strongly recommended for children at all times while on board. Wearing a life jacket while swimming in the sea is mandatory for children, regardless of swimming ability.

10. Guest Count

The charter is confirmed for the number of guests specified at the time of booking. No refund will be provided for unused capacity.

Additional guests beyond the booked number may only board upon immediate payment of the applicable per-person charge.

The total number of guests on board must not exceed the legal passenger limit established by applicable Mexican maritime regulations.

11. Booking Extensions

Extensions to the charter duration are subject to availability and applicable local regulations. Requests for an extension must be made at least 60 minutes before the scheduled end of the charter.

Payment for any additional time must be made through official Boat and Bay payment channels. Direct payments to the captain or crew for extensions are not permitted without prior written approval from Boat and Bay. Failure to comply may result in immediate termination of the charter.

12. Beach Stopovers

If a stopover is made at a beach, cove, or beach club, Clients and Guests must return to the vessel at the time designated by the captain. Extensions to a stopover will incur additional charges, payable immediately.

Any delays to the yacht's return caused by a stopover overrun are the Client's responsibility and will be billed at the applicable hourly rate.

13. Seasickness

A passenger experiencing seasickness may request an early return to port, but no refund will be provided for lost charter time. The decision to end the charter early is at the discretion of the affected passenger, in agreement with the captain.

The passenger may choose to disembark at the nearest marina or beach access point. Any additional costs incurred (such as a water taxi) not included in the original charter price are the passenger's responsibility.

14. Items Permitted & Restricted On Board

Guests are welcome to bring personal belongings including clothing, sunscreen, and personal care items.

The following items are strictly prohibited: illegal substances, firearms, weapons, fireworks, hazardous materials, or any item that may endanger passengers, crew, or the vessel. The captain and crew reserve the right to inspect and prohibit any item they deem unsafe.

15. Allergies & Dietary Restrictions

Clients are responsible for informing Boat and Bay of any allergies, dietary restrictions, or medical conditions at least 72 hours prior to the charter date.

Boat and Bay cannot guarantee the absence of allergens in food or beverages provided by third-party catering services. Guests with severe allergies are advised to consult with Boat and Bay before booking and to take appropriate personal precautions.

16. Damages & Liability

The Client is financially responsible for any damage to the vessel, its equipment, or fixtures caused by negligence, misuse, or misconduct by any Guest in the Client's group. Boat and Bay reserves the right to charge the Client for all reasonable repair or replacement costs.

Boat and Bay, its employees, officers, and owners are not liable for personal injury, accidents, illness, theft, damage to, or loss of personal property during the charter, except where such liability cannot be excluded by applicable law.

Boat and Bay's total liability to the Client shall not exceed the total amount paid by the Client for the charter.

17. Communication & Contact Information

All communications related to current or future charters must be conducted exclusively through official Boat and Bay channels. Clients and Guests are not permitted to exchange personal contact information with the captain or crew for the purpose of arranging charters independently.

18. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of Mexico.

Any dispute arising from or relating to these Terms shall first be submitted to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Bahia de Banderas, Nayrait, Mexico.

By confirming a reservation with Boat and Bay, the Client agrees to be bound by these Terms & Conditions in their entirety.
