You share personal details with Boat and Bay so that one person can plan your day well. This page explains exactly what is collected, why, who ever sees it, and how to have it corrected or removed — in plain language, before you are asked for any of it.

Only what the day requires

We collect what is needed to plan, confirm, and run your charter. Nothing more, and nothing speculative.

Your rights, one email

Access, correct, or delete your information, or withdraw consent, by writing to yourelax@boatandbay.com. No forms, no hold music.

Never sold

Your information is never sold, rented, or traded. Not to advertisers, not to other operators, not to anyone.

Your day stays private

Nothing from your charter is published without your written permission. No photographs, no names, no dates.

One reader

Oksana handles your information personally. Partners receive only the single detail they need to do their part — no more.

Held to Mexican law

Your information is protected under Mexico's federal data protection law, with your rights enforceable in Bahía de Banderas, Nayarit.

Boat and Bay is a curator of private yacht charters — not a vessel owner or crew employer. That shape matters here too: we pass on only what partners need, and we say so plainly below.

SECTION ONE

Who is responsible for your information

Boat and Bay is operated by its founder, Oksana Fajardo, as a registered Mexican business activity based in Bahía de Banderas, Nayarit, Mexico. For the purposes of Mexico's Federal Law on the Protection of Personal Data Held by Private Parties, she is the party responsible for your personal information.

There is no data department. The person who reads your inquiry, plans your charter, and greets you at the dock is the same person accountable for how your details are kept. Questions about this notice go to yourelax@boatandbay.com and are answered personally.

SECTION TWO

What is collected, and when

Information arrives in stages, and each stage collects only what it requires.

WHEN YOU INQUIRE

Your name, email address, phone or WhatsApp number, preferred dates, group size, the occasion, and anything you choose to tell us about it.

PAYMENT

Card and PayPal payments are processed by the payment provider on their own secure systems. Boat and Bay never sees or stores full card numbers.

WHEN YOU CONFIRM

Billing details for your invoice, your menu and beverage selections, and the guest names required for the vessel's passenger manifest. For guests under eighteen, a parent or guardian's name and signature.

ON THE WEBSITE

Anonymized usage data — pages visited, device type, approximate region — collected through cookies and standard analytics tools. It is never connected to your booking.

A NOTE ON ALLERGIES AND DIETARY DETAILS

If you share an allergy, a dietary requirement, or a medical note, it is treated as sensitive information under Mexican law. It is used for exactly one purpose — keeping you safe and the galley prepared — shared only with the chef or crew who need it, and deleted after your charter.

SECTION THREE

Why it is used

Your information is used to:

Respond to your inquiry and hold the conversation that shapes your charter

Plan, confirm, and coordinate the day — vessel, crew brief, chef, and any additions

Prepare the passenger manifest the captain is required to carry

Issue a proper invoice and meet Mexican tax and accounting obligations

Reach you quickly if weather, port status, or timing requires a decision

Occasional correspondence — a note when something worth knowing changes in the bay — is sent only if you have asked for it, and stops the moment you say so. There is no automated marketing machine behind this website. There is a person with your email address and a sense of restraint.

SECTION FOUR

Who ever sees it

Boat and Bay is a curator. Delivering your day involves partners, and honesty about what each one receives is part of the service.

CAPTAIN & PARTNER CREW

Receive the guest names on the passenger manifest — a requirement of Mexican port authorities for every departure — and the service brief for your day. Never your billing details.

CHEF & ADD-ON PARTNERS

Receive only the preferences relevant to their work: the menu, the allergy note, the timing of the cake.

PAYMENT PROVIDERS

Payment providers and banks handle your payment on their own systems, under their own certifications.

WEBSITE PLATFORMS

The platforms that run this website — hosting, forms, and analytics — process data on our behalf under their published privacy terms.

CONCIERGE OR ADVISOR

Your hotel concierge or travel advisor, when your booking arrives through one, receives only the confirmation details they already coordinate on your behalf.

That is the complete list. Your information is never sold, rented, exchanged, or used to build advertising audiences. If a Mexican authority lawfully requires disclosure — the harbor master reviewing a manifest, for example — we comply, and nothing more.

PHOTOGRAPHY AND DISCREATION

Your charter is not our content

Many of our guests are marking something private — a proposal, an anniversary, a family gathering years in the making. Some simply prefer not to appear on the internet.

So the rule is absolute: no photograph, name, date, or detail from your charter is ever published, posted, or shared without your written permission. Not on this website, not on social media, not in a portfolio.

 

What happens on the water belongs to you. If you would like your day featured, tell us — we will ask properly, in writing, and you may change your mind at any time.

SECTION FIVE

How it is protected, and for how long

Your information lives on encrypted, access-controlled platforms. It is read by one person, on protected devices, for the purposes described above — not circulated through inboxes or shared drives.

Booking and invoicing records are kept for as long as Mexican tax and accounting law requires, then deleted. Inquiry details that never become a booking are not kept indefinitely: if the conversation ends, so does our reason to hold your information, and it is removed in our periodic reviews. Sensitive notes — allergies, medical details — are deleted after your charter.

SECTION SIX

Your rights

Under Mexican data protection law you hold four rights over your personal information, known as the ARCO rights, along with two more we extend as a matter of course.

Access

Ask what information we hold about you, and receive a complete answer.

Rectification

Have anything inaccurate or outdated corrected.

Cancellation

Have your information deleted, where no legal obligation requires us to keep it.

Opposition

Object to a specific use of your information.

Withdrawal

Withdraw any consent you have given, at any time, without explanation.

Quiet

Stop any correspondence with a single reply. It will not be argued with.

To exercise any of these, write to yourelax@boatandbay.com from the address we hold for you, stating what you would like done. You will receive a personal reply, and the law allows twenty business days for a full response — in practice, expect it far sooner.

Cookies

This website uses cookies for two purposes: keeping the site working as designed, and understanding — anonymously — which pages are read and which are not. No cookie on this site identifies you personally or follows you across the internet on our behalf.

 

You can disable cookies in your browser settings at any time. Some features of the site may behave differently if you do.

SECTION EIGHT

Guests visiting from outside Mexico

Most of our guests inquire from the United States and Canada. Your information is processed in Mexico, under Mexican federal data protection law, which differs in structure from the laws of your home country but rests on the same principles: collect little, say why, protect it, and answer for it.

Where your home jurisdiction grants you additional rights, write to us — the practical answer is the same one this notice already gives: ask, and it will be handled.

SECTION NINE

Changes to this notice

When the law or our operations change, this notice changes with them, and the date at the top of the page is updated. Material changes — anything that alters what is collected or who receives it — will be noted plainly at the top of this page for ninety days.
